When Are Witnesses Required for a Notarization in Florida?

As a mobile notary in Palm Beach County

, I’m often asked: “Do I need witnesses for this document?” The answer: sometimes. Here’s what Florida law says and how to be ready.

Florida Documents That Require Witnesses

  • – Durable Power of Attorney
  • – Living Will / Advance Directive
  • – Health Care Surrogate Designation
  • – Real estate deeds, including Lady Bird Deeds

Facility-Based Signings

Hospitals, nursing homes, and rehab centers often do not allow staff to act as witnesses. Make sure two unrelated adults can be present.
